Justice Kennedy Retires: The Future of the United States Judiciary

With the retirement of Justice Anthony Kennedy, the battle for the Supreme Court began. In his 30 years on the court, Justice Kennedy has served as the “swing vote,” siding with both liberals and conservatives on different cases. With his retirement, President Trump now has an extraordinary opportunity to determine the makeup of the highest court in the land for generations to come. He can continue choosing judges that will consistently apply the laws as written in our Constitution and not rewrite them.

Judicial Activism

Sadly, our judicial system has increasingly been overtaken by activists seeking to rewrite and make new laws with complete disregard of our country’s founding documents. In an article written by the Heritage Foundation in 2013, they outline several examples of judicial activism, including cases of free speech and abortion. One example of judicial activism is Roe V. Wade, which legalized abortion nationwide in 1973.

In Roe V. Wade, the Supreme Court ruled, in a 7-2 decision, that the right to privacy under the Due Process Clause of the 14th Amendment included a woman’s right to get an abortion. This ruling was fallacious in several ways, including the fact that nowhere in the Constitution did it state, nor even imply, that access to abortion is a protected right. Roe V. Wade was a classic example of judicial activism, with judges rewriting the laws as they see fit.

The very real problem of judicial activism is why the fight to confirm the next Supreme Court Justice, and future justices is so essential. The left is not interested in “mainstream judges” or complete impartiality; they are only interested in furthering the cause of fundamentally transforming America in favor of their radical ideals.

What Should Our Next Justice Consist Of?

The one thing we must expect out of our next Justice is fidelity to our Constitution, the rule of law, and always to put America First when deciding each case. We do not need a “conservative” judge, a “moderate” judge,” or a “liberal” judge. We should not have justices who have shown clear partisan leanings, for all justices should be apolitical at all times, which is precisely what the left does not want.

The left wants someone who will be a reliable defender of their radical agenda in the courts. The American people need someone who will uphold the laws as intended and not circumvent our founding documents to make new law. The future course our judiciary takes will be determined by what happens in this year’s midterm elections.

The Final Outcome

When President Trump’s Supreme Court nominee is confirmed, it will be an accomplishment for so many to celebrate and cherish. Despite this impending confirmation, the fight to maintain the future integrity of our judiciary will still be far from over.

The future of the Supreme Court and all other judicial nominations will be decided in this year’s elections when we vote for our Senators, who have the final say in all judicial nominations.
